Agreement:

BGM Network, Inc. (BGM) is pleased to offer Station/Pgm for broadcast, The CD TEX RADIO SHOW, a weekly radio Program. Each Program shall be two (2) hours in duration, fully produced with a total of SIX (6) national barter minutes, and SIX (6) minutes per hour for local sale, totaling 12 minutes each per show. Station/Pgm agrees to broadcast the Programin its entirety (including commercial announcements and billboards) as furnished to Station/Pgm by BGM. Term of this Agreement shall begin on confirmation of this application and shall continue until so cancelled by either party by giving the other not less than thirty (30) days notice via voice, USPS, or e-mail. Station/Pgm agrees to broadcast the Program at least once each week (as scheduled above). In the event of Program pre-emption, Station/Pgm shall may re-schedule Program to the best available time. Station/Pgm shall complete quarterly affidavits of performance, as provided by CD TEX, showing Station/Pgm carriage of Program and commercials. Affidavit notices will be sent via email to all affiliates, which may be completed online. Station/Pgm shall have exclusive broadcast rights to Program in Station's/Pgm's metro area during Term of Agreement. Internet webcast affiliates shall have a non-exclusive right to the show. Station/Pgm warrants that it has all necessary equipment to receive and broadcast the Program, which shall be delivered via download each week. Station agrees that BGM shall bear no responsibility for any failure or delays in presenting the Programs hereunder, whether resulting from technical difficulties, force majeure, or any other cause. Station shall hold BGM and CD TEX blameless for any claims, costs, or damages resulting therefrom, or for any other cause. By submitting this form, you agree that you have the authority to do so, and agree to the terms herein.
